HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

DaVinci MedEsthetic is committed to protecting the privacy of your protected health information ("PHI"). We are required by law to maintain the privacy of your PHI, to provide you with this Notice of our legal duties and privacy practices, and to follow the terms of the Notice currently in effect.

How We May Use and Disclose Your Health Information

We may use and disclose your PHI for the following purposes without your separate authorization:

  • Treatment: To provide, coordinate, and manage your care, including sharing information with other providers involved in your treatment.
  • Payment: To bill and obtain payment for the services we provide, including verifying coverage and processing payments.
  • Health Care Operations: For activities such as quality improvement, training, scheduling, and general administration of our practice.
  • Appointment Reminders and Follow-up: To contact you about appointments, treatment alternatives, or other health-related benefits and services.
  • As Required by Law: When federal, state, or local law requires the use or disclosure.
  • Public Health and Safety: To prevent a serious threat to health or safety, or for public health activities permitted by law.

Uses and Disclosures That Require Your Written Authorization

Most uses and disclosures of psychotherapy notes (if any), uses and disclosures for marketing purposes, and any sale of PHI require your written authorization. We will not use or disclose your PHI in these ways without your authorization, and you may revoke an authorization in writing at any time.

Marketing and Tracking Technologies

We do not sell your PHI. We do not use online tracking technologies in a manner that discloses your PHI to third-party advertisers without your authorization. We take steps to limit analytics and advertising trackers on pages that could reveal your health interests.

Your Rights Regarding Your Health Information

  • Right to Access: You may inspect and obtain a copy of your PHI that we maintain, in the form and format you request when readily producible.
  • Right to Amend: You may request that we amend PHI you believe is incorrect or incomplete.
  • Right to an Accounting of Disclosures: You may request a list of certain disclosures we have made of your PHI.
  • Right to Request Restrictions: You may request restrictions on certain uses and disclosures. You also have the right to restrict disclosure to a health plan for services you paid for in full out of pocket.
  • Right to Confidential Communications: You may request that we communicate with you by alternative means or at an alternative location.
  • Right to a Paper Copy: You may obtain a paper copy of this Notice upon request, even if you agreed to receive it electronically.
  • Right to Be Notified of a Breach: You have the right to be notified following a breach of unsecured PHI.

Our Responsibilities

  • We are required by law to maintain the privacy and security of your PHI.
  • We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.
  • We must follow the duties and privacy practices described in this Notice and give you a copy of it.
  • We will not use or share your information other than as described here unless you tell us we can in writing.

Changes to This Notice

We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have, as well as any information we receive in the future. The current Notice will be posted at our practice and on our website with its effective date.

How to File a Complaint

If you believe your privacy rights have been violated, you may file a complaint with us by contacting our Privacy Officer at (305) 207-3414 or info@davincimedesthetics.com. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.
